Oscar Luigi SCALFARO

Oscar Luigi Scalfaro  è nato a Novara il 9 settembre 1918  e morto a Roma il 29 gennaio 2012 è stato un politico e magistrato italiano, nono Presidente della Repubblica Italiana dal 1992 al 1999.

Fu eletto deputato ininterrottamente dal 1946 al 1992, quando, durante la sua presidenza della Camera dei deputati, fu eletto Presidente della Repubblica Italiana. In precedenza era stato Ministro dell’interno nel Governo Craxi I, nel Governo Craxi II e nel Governo Fanfani VI, fu anche Ministro dell’Istruzione nel Governo Andreotti II.

Come Capo dello Stato ha conferito l’incarico a sei Presidenti del consiglio: Giuliano Amato (1992-1993), Carlo Azeglio Ciampi (1993-1994), Silvio Berlusconi (1994-1995),Lamberto Dini (1995-1996), Romano Prodi (1996-1998) e Massimo D’Alema (1998-2000).

Era figlio del barone Guglielmo e di Rosalia Ussino. Agli Scalfaro, famiglia originaria della Calabria (Sambiase ora Lamezia Terme) fu concesso il titolo baronale sul cognome da Gioacchino Murat con patente del 7 settembre 1814 all’antenato catanzarese Raffaele Aloisio Scalfaro, comandante la Legione Provinciale di Calabria Ultra. Quest’ultimo avrebbe in seguito presieduto il consiglio di guerra che nel 1815 condannò a morte lo stesso Murat.

Aveva una sorella, Concetta che aveva sposato Gaudenzio Cattaneo, sindaco di Stresa. Il padre era nato a Napoli il 21 dicembre 1888 da padre napoletano, mentre la madre era piemontese; ciò indusse Scalfaro a definirsi, nell’occasione di una visita di stato negli Stati Uniti d’America, figlio dell’Unità d’Italia.

Ancora dodicenne Scalfaro si iscrisse alla GIAC (Gioventù Italiana di Azione Cattolica), appartenenza che ha sempre ostentato (portò sempre all’occhiello della giacca il distintivo tondo dell’Azione Cattolica visibile anche quando, appena eletto alla massima carica pubblica italiana, fece in televisione le brevi dichiarazioni di rito).

Si formò in ambienti cattolici e sin da giovanissimo partecipò all’attività dell’Azione Cattolica, in un periodo in cui questa organizzazione veniva avversata dal fascismo. In particolare fu attivo negli ambienti della FUCI, che in quegli anni raccolse i maggiori esponenti della futura classe dirigente cattolica. Durante la lotta partigiana, ebbe contatti con il mondo degli antifascisti. Il 16 settembre 1951 presso l’Oasi Santa Maria degli Angeli di Erba fece la professione dei consigli evangelici alla presenza dei fondatori dell’istituto dei Missionari della regalità di Cristo. Nel 1957 prese attivamente parte al I Congresso eucaristico diocesano di Sansepolcro, su invito del vescovo mons.Domenico Bornigia.

L’attività di magistrato

Laureatosi in Giurisprudenza all’Università Cattolica del Sacro Cuore di Milano nel 1941, fu chiamato alle armi e assegnato al 38º Reggimento di Fanteria a Tortona. Sottotenente di Commissariato in Sicilia, fu congedato, in quanto magistrato, nell’ottobre del 1942.

Il 26 dicembre 1943 sposò a Novara Mariannuzza Inzitari , che morì, appena ventenne, nel dare alla luce la loro unica figlia, Marianna Scalfaro.

Dopo il 25 aprile 1945 fece richiesta per entrare nelle Corti straordinarie di Assise, composte da giuristi volontari (per una durata prevista di sei mesi), istituite il 22 aprile su richiesta degli angloamericani per porre un freno ai processi sommari del dopoguerra contro i fascisti, talora degenerati in veri e propri linciaggi.

Dal 1º maggio 1945 fu, giovanissimo, consulente tecnico giuridico del Tribunale d’emergenza di Novara, un tribunale speciale per giudicare i criminali fascisti e i collaborazionisti, poi anche pubblico ministero.

Come membro dell’Assemblea Costituente, Scalfaro promosse l’abolizione della pena di morte dall’ordinamento giuridico della Repubblica Italiana. Abolizione applicata, durante il suo settennato, anche al codice penale militare di guerra.

I primi passi nella politica

Arrivò, prima dell’inizio della carriera politica, alla carica di Presidente dell’Azione Cattolica della Diocesi di Novara e Delegato Regionale per il Piemonte.

Lasciò la toga per la politica nel 1946: fu eletto a Torino, fra i più giovani nelle file della Democrazia Cristiana, all’Assemblea Costituente che doveva redigere una nuova Carta Costituzionale. In seguito dichiarò in un libro di non avere mai avuto vocazione per la politica e di essersi trovato alla Costituente senza avere alcuna attrattiva per “quel mestiere”.

Anticomunista e antifascista, si iscrisse finalmente alla DC e partecipò alla battaglia politica del 1948 senza abbandonare per questo l’Azione Cattolica che, presieduta da Luigi Gedda, appoggiava la DC con Comitati Civici istituiti per l’occasione; ottenne oltre cinquantamila preferenze.

Anni cinquanta/sessanta

Politicamente Scalfaro fu inizialmente schierato all’ala destra della Democrazia Cristiana. Pur avendo sempre goduto di grande stima (ricambiata) da parte di Alcide De Gasperi, il suo punto di riferimento fu Mario Scelba . Nel 1958 Mario Scelba formò nella DC una “corrente” (Centrismo popolare) di politici conservatori che aveva come referenti principali, oltre a lui stesso, che ne era il leader, Guido Gonella, Roberto Lucifredi, Mario Martinelli e Oscar Luigi Scalfaro, tutti componenti il Comitato di direzione. La corrente aveva ne “Il Centro” il suo organo di stampa, e verrà sciolta dal suo stesso leader otto anni dopo.

Coerente alla sua concezione anticomunista, all’inizio degli anni sessanta Scalfaro si oppose fermamente alla cosiddetta “apertura a sinistra” cioè all’ingresso del Partito Socialista Italiano nella compagine governativa (centro-sinistra). In questa battaglia interna al partito ebbe come alleato Giulio Andreotti e la sua corrente. L’alleanza con il partito di Pietro Nenni, auspicata dall’allora Presidente della Repubblica Giovanni Gronchi, fu poi realizzata da Amintore Fanfani e da Aldo Moro a partire dal 1963.

Il periodo di ombra

L’avvento del centro-sinistra segnò il declino definitivo del suo referente Mario Scelba e nell’aprile del 1969 Scalfaro fondò, all’interno della DC, una sua corrente, “Forze libere”, ma la scarsa adesione al congresso del partito svoltosi a giugno di quell’anno (meno del 3% dei voti e quattro seggi) non fu incoraggiante: la corrente verrà sciolta ufficialmente quattro anni dopo. Ricoprì l’incarico di Ministro dei trasporti e dell’aviazione civile nel primo governo presieduto da Giulio Andreotti nel 1972 e quello di Ministro della Pubblica Istruzione nel secondo governo Andreotti lo stesso anno.

Nel 1972 polemizzò aspramente contro i socialisti, il cui neo segretario Francesco De Martino auspicava per il governo “equilibri più avanzati”, cioè l’ingresso del PCI nella maggioranza di governo. Si batté altrettanto vigorosamente contro l’approvazione della legge Fortuna-Baslini, che introdusse il divorzio in Italia e fu un sostenitore del ricorso al referendum abrogativo della stessa legge, nel quale, tuttavia, vinsero i “NO” (12 maggio 1974: in quell’occasione fu alleato di Amintore Fanfani che aveva promosso la consultazione elettorale abrogativa).

Presidente della Repubblica

Il 25 maggio 1992 Scalfaro fu eletto Capo dello Stato (al sedicesimo scrutinio) con 672 voti, espressi dai democristiani, dai socialisti, dai socialdemocratici, dai liberali, dal PDS, dai Verdi, dai Radicali e dalla Rete.

Nella XI legislatura

Cominciò con il nominare Giuliano Amato presidente del consiglio, scegliendo da una terna di nomi (Amato-De Michelis-Martelli), «…da intendersi (…) in ordine non solo alfabetico», come disse Bettino Craxi – in televisione all’uscita dalla Sala alla Vetrata del Quirinale – nel presentargliela. Nelle memorie di Enzo Scotti, si apprese che il suo segretario generale, Gaetano Gifuni, avrebbe contattato sia Scotti sia Martelli per sondare la possibilità di una nomina nelle “seconde file” dei due principali partiti della coalizione di governo, allo scopo di propiziare un avvicendamento generazionale alla guida dei rispettivi partiti.Nel 1993 scoppiò lo “scandalo SISDE”, relativo alla gestione di fondi riservati.

Partita dalla bancarotta fraudolenta di un’agenzia di viaggi i cui titolari erano funzionari del servizio segreto del Viminale, un’inchiesta della magistratura fece emergere fondi “neri” per circa 14 miliardi depositati a favore di altri 5 funzionari; ci furono l’intervento del Consiglio superiore della magistratura per dissidi fra il magistrato che indagava e il suo procuratore capo, quello della commissione parlamentare d’inchiesta sui servizi segreti, presieduta da Ugo Pecchioli, e quello del ministro dell’interno Nicola Mancino, e tutti si misero a indagare sull’operato del Servizio mentre a San Marino venivano individuati altri 35 miliardi di uguale sospetta provenienza. Nel frattempo la figlia di Scalfaro, Marianna, fu fotografata in compagnia dell’architetto Adolfo Salabé (la vera ragione dell’incontro era il suo progetto per l’arredamento del palazzo del Quirinale e l’appartamento di rappresentanza nella Palazzina del Presidente), sospettato di intrattenere affari per lui eccessivamente vantaggiosi con l’ente e che nel 1996 patteggiò la pena per le diverse imputazioni ricevute.

I funzionari fornivano versioni di uso “regolare” dei fondi riservati, ma in ottobre uno degli indagati, Riccardo Malpica, ex direttore del servizio e agli arresti da due giorni, affermò che Mancino e Scalfaro gli avrebbero imposto di mentire; aggiunse inoltre che il SISDE avrebbe versato ai ministri dell’interno 100 milioni di lire ogni mese. La sera del 3 novembre 1993 Scalfaro si presentò in televisione, a reti unificate e interrompendo la telecronaca diretta della partita di Coppa UEFA tra il Cagliari e la squadra turca del Trabzonspor, con un messaggio straordinario alla nazione nel quale pronunciò l’espressione “Non ci sto”, parlò di “gioco al massacro” e diede una chiave di lettura dello scandalo come di una rappresaglia della classe politica travolta da Tangentopoli nei suoi confronti.

È stato l’unico Capo dello Stato (tra quelli cessati dalla carica) della storia d’Italia a non aver nominato alcun senatore a vita, a causa di un problema legato all’interpretazione della Costituzione: non è chiaro infatti se il limite di 5 senatori a vita sia da intendersi come limite massimo di nomine a disposizione di ciascun Presidente oppure a disposizione del Presidente della Repubblica come figura istituzionale (quindi comprendendo anche quelli nominati dai predecessori). Il Presidente Scalfaro era fedele alla seconda interpretazione, a differenza dei suoi due predecessori Pertini e Cossiga, che avevano nominato 5 senatori a vita ciascuno. Terminato il suo mandato di Presidente della Repubblica si concluse il 15 maggio 1999, Scalfaro divenne senatore a vita in quanto Presidente emerito della Repubblica, aderendo al gruppo misto.

È morto nel sonno il 29 gennaio 2012, a Roma all’età di 93 anni. Per suo volere le esequie sono state celebrate l’indomani in forma privata, anziché con funerale di Stato come previsto dalla legge per i presidenti emeriti della Repubblica. In seguito il feretro venne trasportato e inumato presso il cimitero di Cameri, nel novarese.

Oscar Luigi Scalfaro was born in Novara on 9 September 1918 and died in Rome on 29 January 2012 he was an Italian politician and magistrate, ninth President of the Italian Republic from 1992 to 1999.

He was elected deputy uninterruptedly from 1946 to 1992, when, during his presidency of the Chamber of Deputies, he was elected President of the Italian Republic. Previously he had been Minister of the Interior in the Craxi I Government, in the Craxi II Government and in the Fanfani VI Government, he was also Minister of Education in the Government Andreotti II.

As Head of State he appointed six Presidents of the Board: Giuliano Amato (1992-1993), Carlo Azeglio Ciampi (1993-1994), Silvio Berlusconi (1994-1995), Lamberto Dini (1995-1996), Romano Prodi (1996-1998) and Massimo D’Alema (1998-2000).

He was the son of Baron Guglielmo and Rosalia Ussino. Agli Scalfaro, a family originally from Calabria (Sambiase now Lamezia Terme) was granted the baronial title on the surname by Gioacchino Murat with a license dated September 7, 1814 to the ancestor of Catanzaro Raffaele Aloisio Scalfaro, commanding the Provincial Legion of Calabria Ultra. The latter would later preside over the war council which in 1815 condemned Murat himself to death.

He had a sister, Concetta who had married Gaudenzio Cattaneo, mayor of Stresa. The father was born in Naples on December 21st 1888 from a Neapolitan father, while his mother was from Piedmont; this led Scalfaro to define himself on the occasion of a state visit to the United States of America, the son of the Unification of Italy.

Still twelve year old Scalfaro enrolled in the GIAC (Italian Youth of Catholic Action), membership that has always flaunted (he always brought to the buttonhole of the round badge of the Catholic Action visible even when, just elected to the highest Italian public office, made on television short ritual statements).

He trained in Catholic circles and from an early age he participated in the activity of Catholic Action, at a time when this organization was opposed by fascism. In particular, he was active in the FUCI circles, which in those years gathered the leading exponents of the future Catholic ruling class. During the partisan struggle, he had contacts with the world of anti-fascists. On September 16, 1951 at the Oasis Santa Maria degli Angeli di Erba he made the profession of evangelical counsels in the presence of the founders of the Institute of the Missionaries of the Kingship of Christ. In 1957 he actively took part in the first diocesan Eucharistic Congress of Sansepolcro, at the invitation of the bishop mons. Domenico Bornigia.

The activity of magistrate

He graduated in Law at the Catholic University of the Sacred Heart in Milan in 1941, was called to arms and assigned to the 38th Infantry Regiment in Tortona. Sub-commissioner in Sicily, he was dismissed as magistrate in October 1942.

On December 26, 1943 he married in Novara Mariannuzza Inzitari, who died, just twenty years old, in giving birth to their only daughter, Marianna Scalfaro.

After April 25, 1945, he applied to enter the extraordinary Courts of Assizes, composed of volunteer jurists (for an expected duration of six months), set up on 22 April at the request of the Anglo-Americans to curb the post-war summary trials against the fascists, sometimes degenerated into real lynchings.

From 1 May 1945 he was, at a very young age, a legal technical advisor to the Novara Emergency Court, a special court to judge the fascist criminals and collaborators, then also the public prosecutor.

As a member of the Constituent Assembly, Scalfaro promoted the abolition of the death penalty from the legal system of the Italian Republic. Abolition applied, during its seven-year period, also to the military war criminal code.

The first steps in politics

Before the beginning of his political career, he arrived as President of the Catholic Action of the Diocese of Novara and Regional Delegate for Piedmont.

He left the toga for politics in 1946: he was elected in Turin, among the youngest in the ranks of the Christian Democrats, in the Constituent Assembly that was to draft a new Constitutional Charter. He later declared in a book that he had never had a vocation for politics and that he had found himself at the Constituent without having any attraction for “that profession”.

Anticommunist and anti-fascist, he finally joined the DC and participated in the political battle of 1948 without abandoning for this the Catholic Action which, chaired by Luigi Gedda, supported the DC with Civic Committees set up for the occasion; he obtained over fifty thousand preferences.

The fifties / sixties

Politically Scalfaro was initially deployed to the right wing of the Christian Democrats. Although he has always enjoyed great esteem (reciprocated) by Alcide De Gasperi, his point of reference was Mario Scelba. In 1958, Mario Scelba formed a “current” (Popular Centrism) of conservative politicians in DC who had as main referents, in addition to himself, who was the leader, Guido Gonella, Roberto Lucifredi, Mario Martinelli and Oscar Luigi Scalfaro, all components the Management Committee. The current had its press organ in “The Center,” and was released by its own leader eight years later.

Consistent with his anti-communist conception, at the beginning of the sixties Scalfaro firmly opposed the so-called “opening to the left”, that is, at the entrance of the Italian Socialist Party in the government (center-left). In this internal party battle Giulio Andreotti and his current were allied. The alliance with the party of Pietro Nenni, desired by the then President of the Republic Giovanni Gronchi, was then realized by Amintore Fanfani and Aldo Moro starting from 1963.

The period of shadow

The advent of the center-left marked the definitive decline of its referent Mario Scelba and in April 1969 Scalfaro founded, in the DC, a current, “Free Forces”, but the lack of adhesion to the party congress held in June of that year (less than 3% of the votes and four seats) was not encouraging: the current will be officially dissolved four years later. He served as Minister of Transport and Civil Aviation in the first government chaired by Giulio Andreotti in 1972 and Minister of Education in the second Andreotti government the same year.

In 1972 he bitterly opposed the Socialists, whose new secretary Francesco De Martino called for “more advanced balances” for the government, that is, the entry of the PCI into the majority of the government. He fought equally vigorously against the approval of the Fortuna-Baslini law, which introduced the divorce in Italy and was a supporter of the appeal to the referendum abrogating the same law, in which, however, they won the “NO” (May 12, 1974: in that the occasion was an ally of Amintore Fanfani who had promoted the abrogating electoral consultation).

President of the Republic

On May 25, 1992 Scalfaro was elected Head of State (in the sixteenth scrutiny) with 672 votes, expressed by the Christian Democrats, the Socialists, the Social Democrats, the Liberals, the PDS, the Greens, the Radicals and the Net.

In the XI legislature

He began by appointing Giuliano Amato as president of the council, choosing from a set of names (Amato-De Michelis-Martelli), «… to be understood (…) in alphabetical order», as Bettino Craxi said – on television at the exit from the Sala alla Vetrata del Quirinale – in presenting it to him. In the memoirs of Enzo Scotti, it was learned that his general secretary, Gaetano Gifuni, would contact both Scotti and Martelli to explore the possibility of an appointment in the “second rows” of the two main parties of the governing coalition, with the aim of propitiating a change generational under the leadership of the respective parties. In 1993 the “SISDE scandal” broke out, concerning the management of reserved funds.

Started by the fraudulent bankruptcy of a travel agency whose owners were officials of the secret service of the Viminale, an investigation by the magistracy brought out “black” funds for about 14 billion deposited in favor of 5 other officials; there was the intervention of the Superior Council of the judiciary for disagreements between the investigating magistrate and his chief prosecutor, that of the parliamentary commission of inquiry on the secret services, presided by Ugo Pecchioli, and that of the interior minister Nicola Mancino, and all began to investigate the work of the Service while in San Marino were identified another 35 billion of the same suspected provenance. Meanwhile, the daughter of Scalfaro, Marianna, was photographed in the company of architect Adolfo Salabé (the real reason for the meeting was his project for the furnishing of the Quirinale palace and the representative apartment in the President’s Palazzina), suspected to entertain business that was excessively advantageous to him and that in 1996 he pledged the penalty for the various charges received.

Officials provided versions of “regular” use of reserved funds, but in October one of the suspects, Riccardo Malpica, former director of the service and arrests for two days, said that Mancino and Scalfaro would have forced him to lie; he also added that SISDE would pay 100 million lire each month to the ministers. On the evening of 3 November 1993, Scalfaro showed up on television, unified networks and interrupting the direct commentary on the UEFA Cup match between Cagliari and the Turkish team of Trabzonspor, with an extraordinary message to the nation in which he pronounced the expression ” I am, “he spoke of” play the massacre “and gave a key to the scandal as a reprisal of the political class overwhelmed by Tangentopoli against him.

He was the only Head of State (among those ceased from office) of the history of Italy not to have appointed any senator for life, because of a problem related to the interpretation of the Constitution: it is not clear if the limit of 5 senators for life is to be understood as the maximum number of appointments available to each President or available to the President of the Republic as an institutional figure (thus including those appointed by his predecessors). President Scalfaro was faithful to the second interpretation, unlike his two predecessors Pertini and Cossiga, who had appointed 5 senators for life each. After his term as President of the Republic ended on May 15, 1999, Scalfaro became a senator for life as President emeritus of the Republic, joining the mixed group.

He died in his sleep on January 29, 2012, in Rome at the age of 93. By his will, the funeral was celebrated the following day in private form, rather than with a state funeral as required by the law for the presidents emeritus of the Republic. Later the coffin was transported and buried at the cemetery of Cameri, in the Novara area.
